Sex Offender Registry in the Commonwealth of Massachusetts: Mission:              Promote public safey by registering sexual offenders, residing, working or attending institues of higher learning in Massachusetts; identifying, collecting and reporting factual information leading to the accurate classification of those sex offenders; and disseminating information to the police and public about those offenders deemed to present sufficient risk to the pulbic. Authority: Jacob Wetterling Act & Megan's Law Massachusetts General Law, Chapter 6 Sec 178C - 178Q 803 CMR 1.0 et seq Who is a Sex Offender?         As set forth in G.L. Chapter 6, Sec 178C   Lives, works, or attends post - secondary education in Massachusetts  Adult or juvenile  Convicted, adjudicated, incarcerated, supervised, or released from SDP status for one or more of the  enumerated  sex offenses on or after August 1, 1981. What is NOT a Sex Offense? Indecent exposure Common night walking Adult prostitution Open & gross speech & behaviors Peeping tom Annoying a person of the opposite sex stalking Unnatural acts with a person over 16 What the Board Does NOT Have Authority  To Do: Control where offenders live or work Control who the offenders socially interact with. Control the daily activities of offenders Conditions of release may be set by the courts Classification: Unclassified/Level 0:  This group of offenders are in the process of being classified by the sex offender registry board.  They only have to register directly with the SORB.  Level 1:  Low risk of re-offending.  These offenders register directly with the SORB by mail.  Their information is for law enforcement purposes only, not for release to the public. Level 2:  Moderate risk of re-offending.  These offenders register directly with the police department in the city or town where the offender lives within two calendar days of being notified of their classification.  Dissemination of these offenders information  is passivley disseminated.  Any civilian 18 years of age or older, with positive identification, can go to the local police department and fill out a written reqest form to obtain the offenders information.  These forms are confidential but are kept on file by the department. Level 3: High risk of re-offending.  These offenders register directly with the police department in the city or town where the offender lives withing two calendar days of being notified of their classification.  Level 3 offenders information is activelly disseminated by posting of community notification fliers throughout the city or town.  These may also be obtained by  any civilian 18 years of age or older, with positive identification, by going to the local police department and filling out a written request form.  These forms are confidential but are kept on file by the department. RECENT DEVELOPMENTS: In 2006, there were several changes to the Massachusetts Sex Offender Registry Law:    Sex offenders must now provide both their permanent address and any "Secondary Addresses" where an offender may be living when they register. "Secondary Address or Out of State Address" is defined as "the address of all places where a sex offender lives, abides, lodges, or resides for a period of fourteen (14) or more days in the aggregate during any calendar year and which is not a sex offener's primary address; or a place where a sex offender routinely lives, abides, lodges, or resides for a period of four (4) or more consecutive or nonconsecutive days in any month and which is not a sex offender's permanent address, including any out-of state address." Any sex offender convicted after December 20, 2006 should be classified prior to the offender's release from custody. Certain unclassisfied and Level 1 offenders and all Level 2 and 3 offenders convicted of the crime of failing to register will receive a term of community parole supervision for life in addition to any sentence or fine imposed. Homeless sex offenders must now register every 45 days rather than every 90 days as previously required. It is now a crime for Level 3 sex offenders to "knowingly and willingly" live in certain nursing homes. When Do Offenders Register? Annually the month of their birthday with the sex offender registry (Level 1) or with the police department in the city or town in which they reside (Level 2 & 3).  An offender who receives their annual letter to register has 5 days from receiving the letter to register with the police department in the city or town where they reside. An offender already classifed (Level 2 or 3) and being released from jail has 48 hours to appear at the police department in the city or town where they reside to register. Homeless offenders must verify information every 45 days at the police department in the city or town where they reside.   Sex Offenders Moving into Massachusetts  All sex offenders must register within 2 days of moving into the Commonwealth from another jurisdiction. Sex Offenders Moving within Massachusetts from One Address to Another All sex offenders must register their current and new address at least 10 days prior to: Moving to a different city or town in the Commonwealth; or Moving within the same city or town in the Commonwealth. Out of State Sex Offenders Working in Massachusetts Sex offenders residing in locations outside of Massachusetts, but who are employed in the Commonwealth, must register within 2 days of beginning employment. A person is working in Massachusetts if they come into Massachusetts to work at a full-time or part-time job for a period of time exceeding 14 days or for an aggregate period of time exceeding 30 days during any calendar year, whether compensated or uncompensated. Changes of Work Addresses for All Sex Offenders Sex offenders must register their current and new work address at least 10 days prior to changing a place of employment. Sex Offenders Moving Out of Massachusetts Sex offenders must notify the Board of their new address at least 10 days prior to moving out of the Commonwealth.  Sex offenders who committed their sex offenses in Massachusetts, were convicted of sex offenses in Massachusetts courts, and are required to register in Massachusetts, must register as a sex offender in any state the offender takes up residence, works in, or attends school. Level 3 Sex Offenders Living in Nursing Homes It is a crime for a Level 3 sex offender to "knowingly and willingly" live in any convalescent or nursing home, infirmary maintained in a town, rest home, charitable home for the aged or intermediate care facility for the mentally retarded which meets the requirements of the DPH under G.L. c. 111,  § 71. Penalties for committing this crime are as follows:   First conviction: imprisonment for not more than 30 days in a jail or house of correction; Second conviction: imprisonment for not more than 2 ½ years in a jail or house of correction nor more than 5 years in a state prison or by a fine of not more than $1,000, or by both such fine and imprisonment; and Third and subsequent conviction: imprisonment in a state prison for not less than 5 years; provided, however, that the sentence imposed for such third or subsequent conviction shall not be reduced to less than 5 years, nor suspended. Out of State Sex Offenders Attending Massachusetts Schools Sex offenders residing in locations outside of Massachusetts, who are required to resister as sex offenders in the state in which they but who are also enrolled in any school in the Commonwealth, must register within 10 days of attending the school. All other out of state sex offenders who attend Massachusetts schools must register within 10 days of attending, transferring to, or transferring from the school if the school is an Institution of Higher Learning which is any public or private post secondary educational, vocational, professional or trade institution, college, university, or school.   Penalties for failure to comply with G.L. c. 6, §§ 178C to 178P Sex offenders will be prosecuted for violating the law if they knowingly: Fail to register; Fail to verify registration information; Fail to provide notice of change of address, place of employment, or institution of higher learning; or Provide false information. The penalties for the above-referenced violations are: Imprisonment for not less than 6 months and not more than 2 1/2 years in a house of correction nor more than 5 years in state prison or by a fine of not more than $1,000 or by both; and Certain unclassified and Level 1 offenders and all Level 2 and 3 offender shall receive a term of community parole supervision for life in addition to any sentence or fine imposed. Second and subsequent conviction: imprisonment in state prison for not less than 5 years. Request for Sex Offender Information from City/Town Police Department (M.G. L. Ch 6, Sec 178J) You may request whether: a specific individual by name, date of birth or sufficient personal identifying characteristics is a sex offender, Whether any sex offenders live or work within the same city or town of a specfic address, You may specify near the address of a home, school, daycare facility, playground, etc or Whether any sex offenders live or work on a specific street. In response to your request, you will receive a report which indicates the name of the offender, home address, work address, the offense(s) and date(s) for which the offender was convicted/adjudicated, the offender's age, sex, race, height, weight, eye, hair color and a photograph if available. The law only permits the public to receive information on sex offenders required to register and finally classified by the Sex Offender Registry Board as a level 2 (moderate risk) or level 3 (high risk) offender.  Therefore, information is not available to the public if the sex offender is a level 1 (low risk) offender or if he/she has not yet been finally classifed by the Board. All inquires shall be recorded and kept confidential; provided that the records may be disseminated to assist or defend any criminal prosecution.          The form  states that the requesting party understands that the sex offender registry information disclosed to them is intended for their own protection or for the protection of a child under the age of 18 or another person for whom they have responsibilty, care or custody.  M. G. L. Ch 6, SEc 178J (a)(4)   Level Three Sex Offender Community Notification    The Greenfield Police Department is releasing the following information pursuant to M.G.L. c.6s.178C - 178P which authorizes law enforcement agencies to release information that will enhance public safety and protection. The individuals who appear on this notification have been convicted of a sex offense that requires his/her registration. These individuals have been designated  LEVEL 3 SEX OFFENDERS by the Sex Offender Registry Board (SORB). The board has determined these individuals are at a high risk to re-offend and the degree of dangerousness posed to the public is such that a substantial public safety interest is served by active community notification.  These individuals have served their sentence imposed upon him/her by the court and are NOT WANTED BY THE POLICE. Sex offenders have always lived in our communities: but it was not until the passage of this law (which mandates sex offender registration) that law enforcement could share this information with you. Any abuse of this information to threaten, intimidate or harass registered sex offenders will not be tolerated and could potentially jeopardize our authority to keep the public informed. *********WARNING***********  Sex Offender Registry information shall not be used to commit a crime to engage in illegal discrimination or harassment of an registered offender. Any person who uses information disclosed pursuant to M.G.L. c 6. s 178C-178P for such purposes shall be punished by not more than two and one half (2  1/ 2) years in a house of correction or by a fine of not more than one thousand dollars ($1000.00) or both (M.G.L. c 6 s 178N).  In addition, any person who uses registry information to threaten to commit a crime may be punished by a fine of not more that on hundred dollars ($100.00) or by imprisonment for not more than six (6) months.
